Terms of Service

These terms apply when you use syncmax.ca or buy consultancy, training or IT services from SyncMAX. A signed proposal, statement of work or service agreement takes priority over these terms where they differ.

Agreement

By using this website or buying a service from SyncMAX, you agree to these terms. If you are buying for a company, you confirm you are authorised to bind it. SyncMAX is based at 472 Taunton Road West, Oshawa, ON, Canada.

Our services

  • Consultancy: project management, project controls, scheduling, delay and commercial claims, and forensic schedule analysis, as described in a written proposal or statement of work.
  • Training: PMP, PMI-RMP, PMI-SP and Primavera P6 courses, mock exams, and cybersecurity awareness training. Online P6 courses also have their own course terms, which apply to those purchases.
  • IT services: laptop leasing and managed IT support plans, as described on our IT services page and in your service agreement.

Course content and exam preparation help you prepare, but we do not guarantee that you will pass an exam. PMP, PMI-RMP and PMI-SP are marks of the Project Management Institute. Primavera is a trademark of Oracle. SyncMAX is independent of both, and courses do not include software licences.

Quotes and prices

Prices are in Canadian dollars and do not include taxes unless stated. IT services are priced in your quote or service agreement. Quotes are valid for 30 days unless they say otherwise.

Payment and invoices

  • We process payments through Stripe. You can pay by card and other methods shown at checkout or on the invoice.
  • Invoices are due within the time shown on the invoice (30 days if none is shown). Overdue amounts may be charged interest of 1.5% per month (19.56% per year), and we may pause services until the account is paid.
  • GST/HST and any other applicable sales taxes are added based on your billing address. Businesses can add their tax number at checkout or in the billing portal.
  • You can view and download invoices and update your payment details in our billing portal.

Monthly IT plans

  • Managed IT plans are billed in advance and renew automatically each billing period until cancelled.
  • Cancel any time in the billing portal or by email. Cancellation takes effect at the end of the paid period. Services continue until then, and that period is not refunded.
  • If a payment fails, we retry it automatically and email you. If it is still unpaid after the retries, we may suspend service.
  • We give at least 30 days' notice of price changes.

Laptop leasing

Leased devices remain SyncMAX's property, or our financing partner's, for the full term in your lease schedule. You are responsible for reasonable care of the devices and for loss or damage beyond normal wear. Ending a lease early, and returning devices at the end of the term, follows your lease schedule. At the end of the lease, we securely wipe returned devices and send them for certified recycling.

Cancellations and refunds

Consultancy is charged for work performed up to cancellation, as set out in your proposal. You can cancel training booked with us for a full refund up to 14 days before it starts; after that we offer a transfer to a later date. Online course refunds follow the course terms. Any refund is made to the original payment method.

Intellectual property

Course materials, templates and website content belong to SyncMAX. They are licensed to you for your own or your organisation's internal use and may not be resold or redistributed. Deliverables made for a consultancy client are licensed or assigned as set out in that client's agreement.

Your responsibilities

You agree to give accurate information and timely access to people, records and systems, and to keep your login details safe. Our advice relies on the information you provide. You are responsible for decisions made using it, and for how you use any software, accounts and data under your control.

Limitation of liability

To the extent the law allows, SyncMAX is not liable for indirect, incidental or consequential losses, including lost profits, data or business opportunities. Our total liability for any claim is limited to the fees you paid for the service concerned in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
